Your order is not accepted until FORMENTERA SOCIAL CLUB confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as FORMENTERA SOCIAL CLUB may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. 
Your purchases are subject to return or exchange solely in accordance with our Refund Policy. 
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

SECCIÓN 5 - ENVÍO Y ENTREGA No nos hacemos responsables de los retrasos en los envíos y entregas. Todos los plazos de entrega son únicamente estimaciones y no están garantizados. Además, usted acepta no: (a) cargar o transmitir virus ni ningún otro tipo de código malicioso que se utilice o pueda utilizarse de cualquier forma que afecte a la funcionalidad o al funcionamiento de los Servicios; (b) reproducir, duplicar, copiar, extraer, vender, revender o explotar ninguna parte de los Servicios; (c) recopilar o rastrear la información personal de terceros; (d) enviar spam, phish, pharm o pretextar los servicios; (e) utilizar robots, arañas ("spiders"), herramientas de raspado ("scraping"), recopilación y extracción de datos, dispositivos o procesos automáticos, herramientas de IA (como la IA de agentes) o medios automatizados o manuales para acceder a los Servicios; o (f) interferir con, eludir o burlar las características de seguridad o autorización, los encabezados de exclusión de robots u otras medidas que empleamos para restringir el acceso a los Servicios. Nos reservamos el derecho de suspender, desactivar o cancelar su cuenta en cualquier momento y sin previo aviso si determinamos que ha violado cualquier parte de estos Términos.

SECCIÓN 14 - AGENTES 14.1 Esta sección ("Términos sobre Agentes") se aplica si usted utiliza, permite, habilita o provoca el despliegue de un Agente para acceder, utilizar o interactuar con cualesquiera Servicios. SECCIÓN 15 - RESCISIÓN Podemos rescindir este acuerdo o su acceso a los Servicios (o a cualquier parte de los mismos) a nuestra entera discreción, en cualquier momento y sin previo aviso, y usted seguirá siendo responsable de todos los importes adeudados hasta la fecha de rescisión inclusive. SALVO QUE FORMENTERA SOCIAL CLUB INDIQUE EXPRESAMENTE LO CONTRARIO, LOS SERVICIOS Y TODOS LOS PRODUCTOS OFRECIDOS A TRAVÉS DE LOS SERVICIOS SE PROPORCIONAN 'TAL CUAL' Y 'SEGÚN DISPONIBILIDAD' PARA SU USO, SIN NINGUNA REPRESENTACIÓN, GARANTÍA O CONDICIÓN DE NINGÚN TIPOS, YA SEA EXPRESA O IMPLÍCITA, INCLUYENDO TODAS LAS GARANTÍAS O CONDICIONES IMPLÍCITAS DE COMERCIABILIDAD, CALIDAD COMERCIAL, IDONEIDAD PARA UN PROPÓSITO PARTICULAR, DURABILIDAD, TÍTULO Y NO INFRACCIÓN. NO GARANTIZAMOS, REPRESENTAMOS NI ASEGURAMOS QUE EL USO QUE HAGA DE NUESTROS SERVICIOS SEA ININTERRUMPIDO, PUNTUAL, SEGURO O LIBRE DE ERRORES. ALGUNAS JURISDICCIONES LIMITAN O NO PERMITEN LA EXENCIÓN DE GARANTÍAS IMPLÍCITAS O DE OTRO TIPO, POR LO QUE ES POSIBLE QUE LA EXENCIÓN ANTERIOR NO SE APLIQUE EN SU CASO.

 

SECCIÓN 17 - LIMITACIÓN DE RESPONSABILIDAD EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, EN NINGÚN CASO FORMENTERA SOCIAL CLUB, NUESTROS SOCIOS, DIRECTORES, ADMINISTRADORES, EMPLEADOS, FILIALES, AGENTES, CONTRATISTAS, PROVEEDORES DE SERVICIOS O LICENCIANTES, ASÍ COMO LOS DE SHOPIFY Y SUS FILIALES, SERÁN RESPONSABLES DE NINGUNA LESIÓN, PÉRDIDA, RECLAMACIÓN O DAÑO DIRECTO, INDIRECTO, INCIDENTAL, PUNITIVO, ESPECIAL O CONSECUENTE DE NINGÚN TIPO, INCLUYENDO, SIN LIMITACIÓN, LA PÉRDIDA DE BENEFICIOS, PÉRDIDA DE INGRESOS, PÉRDIDA DE AHORROS, PÉRDIDA DE DATOS, COSTES DE SUSTITUCIÓN O CUALESQUIERA DAÑOS SIMILARES, YA SEA POR CONTRATO, RESPONSABILIDAD EXTRACONTRACTUAL (INCLUIDA NEGLIGENCIA), RESPONSABILIDAD ESTRICTA O DE OTRO TIPO, QUE SE DERIVEN DEL USO DE CUALQUIERA DE LOS SERVICIOS O DE CUALQUIER PRODUCTO ADQUIRIDO UTILIZANDO LOS SERVICIOS, O POR CUALQUIER OTRA RECLAMACIÓN RELACIONADA DE CUALQUIER FORMA CON SU USO DE LOS SERVICIOS O DE CUALQUIER PRODUCTO, INCLUYENDO, PERO SIN LIMITARSE A, CUALQUIER ERROR U OMISIÓN EN CUALQUIER CONTENIDO, O CUALQUIER PÉRDIDA O DAÑO DE CUALQUIER TIPO INCURRIDO COMO RESULTADO DEL USO DE LOS SERVICIOS O DE CUALQUIER CONTENIDO (O PRODUCTO) PUBLICADO, TRANSMITIDO O PUESTO A DISPOSICIÓN DE CUALQUIER OTRA FORMA A TRAVÉS DE LOS SERVICIOS, INCLUSO SI SE AVISÓ DE SU POSIBILIDAD.

SECCIÓN 18 - INDEMNIZACIÓN Usted acepta indemnizar, defender y mantener indemne a FORMENTERA SOCIAL CLUB, Shopify, y a nuestras filiales, socios, administradores, directores, empleados, agentes, contratistas, licenciantes y proveedores de servicios frente a cualquier pérdida, daño, responsabilidad o reclamación, incluidos los honorarios razonables de abogados, pagaderos a cualquier tercero debido a, o que surja de (1) su incumplimiento de estos Términos de Servicio o de los documentos que incorporan por referencia, (2) su violación de cualquier ley o de los derechos de un tercero, o (3) su acceso y uso de los Servicios.
